Not getting selected in the H-1B lottery is disappointing, but it's not the end. There are several paths to continue working in the US legally. Here's a comprehensive guide to your alternatives.

1. Cap-Exempt Employers

No Lottery Required

Universities, research institutions, and certain nonprofits can sponsor H-1B visas year-round without the lottery cap. This is often the fastest path to H-1B status.

2. O-1 Visa (Extraordinary Ability)

Merit-Based

For individuals with extraordinary ability in sciences, arts, education, business, or athletics. No annual cap, but requires strong evidence of achievements.

3. STEM OPT Extension

F-1 Students

If you have a STEM degree, apply for the 24-month STEM OPT extension. This gives you more time and two additional lottery attempts.

4. L-1 Intracompany Transfer

Multinationals

Option 1: Cap-Exempt Employers

Cap-exempt employers can file H-1B petitions at any time without going through the lottery. These include:

Important: If you later move from a cap-exempt to a cap-subject employer, you'll need to go through the lottery at that time. The cap exemption is tied to the employer, not the worker.

Option 2: O-1 Visa for Extraordinary Ability

The O-1 visa is for individuals with extraordinary ability demonstrated by sustained national or international acclaim. It has no annual cap.

O-1A Criteria (Sciences, Business, Education)

You must meet at least 3 of these 8 criteria:

1. Awards or prizes for excellence
2. Membership in associations requiring outstanding achievement
3. Published material about you in major media
4. Judging the work of others in your field
5. Original contributions of major significance
6. Authorship of scholarly articles

Option 3: STEM OPT Extension (F-1 Students)

Frequently Asked Questions

Can I stay in the US if not selected and my OPT is expiring?

If your OPT expires, you have a 60-day grace period. During this time, you cannot work but can prepare to leave, apply for a change of status, or accept a cap-exempt position. If you find a cap-exempt employer, they can file H-1B immediately.

Will there be a second lottery round?

Possibly. If not enough selected registrants file petitions, USCIS may conduct additional selection rounds (typically August-September). Your registration remains valid for the entire fiscal year, so you could be selected later.

Is the O-1 visa harder to get than H-1B?

O-1 has a higher evidence bar (proving extraordinary ability) but no lottery. For candidates with strong achievements, O-1 can be a reliable path. Many successful O-1 applicants have 3-5 years of experience with measurable accomplishments (publications, patents, awards, etc.).

Can I work for a cap-exempt employer part-time?
